The legally binding terms of these documents set out your rights, obligations and restrictions regarding your use of this website (the “Website”) .

Small business lenders, credit marketplaces and brokers who fill out and submit the Attestation Form available through this Website are listed as signatories to the Small Business Borrower’s Bill of Rights, indicating that these companies have represented to SBM that they abide by the SBBOR. SBM does not independently verify that any of these companies or entities in fact abide by the SBBOR and you should not rely solely on the listing of these companies and entities in determining whether or not any particular company or entity does in fact abide by the SBBOR.
The listing of these companies and entities as signatories to the SBBOR on this Website (the “Signatory Companies”) does not imply that SBM endorses the use of any of the Signatory Companies.
The content of the Website is provided "AS-IS" and SBM expressly disclaims any warranty of fitness for a particular purpose and further expressly disclaims any implied warranty and terms and conditions. SBM cannot guarantee and does not promise any specific results from use of the Website.
3. Intellectual Property Rights
You acknowledge and agree that all copyright and other rights in and to the computer programs, computer applications, web applications, database programs, web content files and all written, graphic, audio and audiovisual works constituting, incorporated into and/or utilized on this Website and all databases of any kind, database elements and data fields included in such databases (except to the extent that the foregoing have been created by and licensed to SBM by third parties) shall be and remain the sole and exclusive property of SBM (“SBM Intellectual Property”). You agree not to contest SBM’s ownership of any and all such rights.
You agree that you will not copy, modify, publish, transmit, distribute, perform, display, or sell any of the SBM Intellectual Property. You agree that SBM will not be liable for any failure of any Signatory Company to comply with or abide by the SBBOR or for any other act or omission of any Signatory Company.
You hereby agree to release SBM and its respective officers, directors, agents and employees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your use of the Website. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”
You agree to release and forever discharge SBM, its directors, officers, employees, consultants and agents from any claim for death, injury to person, injury or damage to property or other damages, costs, losses or expenses of whatsoever nature, arising out of or based upon the posting of any information on this Website (including without limitation the listing of the Signatory Companies), your use of or reliance on any such information, or SBM’s sponsorship of this Website or any content posted on this Website.
